Mining Lease & Quarry Permit for Minor Minerals
As per Rule 5 of the Meghalaya Minor Mineral Concession Rules, 2016, the PCCF &HoFF (for area of more than 5 hectares) or DFO Territorial Division (upto 5 hectares area) shall grant Mining lease/Quarry permit in respect of minor minerals for use other than in industries as specified in Schedule III
Present process for applying for Mining lease and Quarry permit under Meghalaya Minor Mineral Concession Rules, 2016
Mining Lease
A. Application shall be made in Form A duly affixed with court fee stamp of Rs 1000 along with following documents:-
- A certificate of Registration of the land under Indian Registration Act, 1908, that is, Sale deed or Gift deed or Declaration Deed or Lease Deed or Land Holding Certificate or Patta duly authenticated by the concerned Authority or Lease Agreement to be certified by a Notary Public or First Class Magistrate
- A certificate as to the status of land whether it is Forest or Non-forest from the PCCF & HoFF or any other officer authorized in this behalf.
- NOC from concerned Autonomous District Council for land use in case the applicant is a company, firm, cooperative society or non-tribal.
- An affidavit that the applicant has, where the land is not owned by him, obtained surface rights over the area or has obtained the consent of the landowner or landowners for grant of mining lease
- Treasury challan for Rs. 5000 as application fee which is non refundable and Treasury challan for Rs 5000 per hectares as fee for grant of mining lease.
B. An application for grant of a mining lease shall be disposed of within a period of 6 months provided that the application for mining lease is complete in all respects.
C. The competent authority issue letter of intent (LOI) directing the applicant to submit following documents for grant of mining lease within period of 6 months:-
- Mining plan duly approved by the ‘authorized officer’ as below:-
Mining engineer, Directorate of Mineral Resources - for Khasi Hills region
Divisional Mining Officer, Jowai- for Jaintia hills region
Divisional Mining Officer, williamnagar- for Garo hills region
- The Forest Clearance under Forest Conservation Act, 1980 in case the status of land is Forest
- Environmental Clearance (EC) under Environment (Protection) Act, 1986 (DEIAA will issue EC Upto 5 ha lease area and SEIAA will issue EC above 5 ha lease area)
- Consent to establish from State pollution Control Board
- Clearance from Revenue and Disaster Management Department whenever applicable under the Meghalaya Transfer of land (Regulation) Act, 1971
- Self-declaration form for due adherence of labour laws and labour safety
D. Work flow
- After obtaining LOI, applicant first will get mining plan prepared by empanelled experts and approved by ‘authorized officer’
- After approval of the mining plan, he/she will apply for Environmental clearance (EC)
- After obtaining EC, he/she will apply for clearance from Revenue and Disaster Management Department whenever required, clearance from pollution control Board and clearance from labour Department
- The applicant submit all the documents/clearances to competent authority
- Survey and demarcation of the area applied for mining lease by applicant and verification of the same by competent authority
- Order of grant of the lease issued by competent authority
- The applicant shall deposit Security Deposit @ 10,000/ha in the form of Letter of credit or, Fixed or term deposit or bank guarantee from any scheduled bank etc.
- Lease deed in Form E shall be executed within 3 months of the order of grant of lease
- Mining lease shall be registered in Sub-Register office and stamp duty shall be paid @ Rate ____% of royalty payable per year as per quantity of minor mineral mentioned in mining plan (____% of average annual royalty calculated on the estimated average annual production as per approved mining plan).
Quarry Permit
- Application shall be submitted in Form F duly affixed with court fee stamp Rs. 100 to competent Authority along with:-
- Certificate as to the status of land whether it is Forest or Non-forest from the PCCF & HoFF or any other officer authorized in this behalf.
- Treasury Challan of Rs 500 as application Fee
- The competent authority shall dispose of the application within 15 days
Conditions for quarry permit
- The period for which quarry permit may be granted shall not exceed 5 years
- The depth of the quarry below surface shall not be more than 3 meters
- The extent of the quarry permit area shall not exceed 2 hectares
